They want to ban it, they want to release it and the controversy has reached Congress!”. The decision is not in the hands of the legislative branch, but in the final instance of the judiciary. Then, this week, the decriminalization of marijuana reached the STF, the Federal Supreme Court, which, by a majority, decided that it is not a crime to carry the plant for personal use.
In other words, carrying up to a certain amount of green (which will still be defined in the coming days) for your own use is no longer considered a crime in the country, but its sale and consumption in public places is still prohibited here. This Wednesday, the 26th, the court will decide how much cannabis constitutes personal use, estimating that the amount should be between 25 and 60 grams or six female cannabis plants.
The case heard by the STF questions article 28 of the so-called “Drug Law” (11.343/2006) which aims to differentiate between users and dealers. However, despite avoiding imprisonment, the user would still suffer an alternative sentence:

- Compulsory attendance at an educational course;

- Community service.
